TERMS OF SERVICE

These Terms of Service apply to the use of the Flow Therapy Byron website and to all services provided by Flow Therapy Byron Pty Ltd including colon hydrotherapy, naturopathy, specialised kinesiology, energetic psychology and other complementary health and wellbeing services we may offer.
By using our website, making a booking, purchasing a service or attending an appointment, you agree to these Terms of Service. If you do not agree with these Terms, please do not use our website or book our services.
1. OUR SERVICES
Flow Therapy Byron provides complementary health and wellbeing services, which may include:
• Colon hydrotherapy / colonic lavage
• Naturopathy
• Specialised kinesiology
• Energetic psychology
• Other complementary health and wellbeing services described on our website or at the time of booking.
Our services take a holistic approach and are intended to support individual health and wellbeing.The nature and scope of each service will depend on the service selected and the information provided during your consultation.Our services are complementary in nature and are not intended to replace appropriate medical diagnosis, treatment or care from a registered medical practitioner or other appropriately qualified health professional.
2. COMPLEMENTARY HEALTH SERVICES
Our services are provided within a complementary and holistic health framework. Depending on the service selected, a consultation may include discussion of nutrition, lifestyle, diet, wellbeing, nutritional supplements, herbal medicine, energetic practices or other complementary approaches. Any recommendations are based on the information available to us at the time of your consultation. Individual responses to complementary health services and recommendations can vary. You are responsible for informing us about relevant health conditions, medications, allergies, pregnancy, supplements and other circumstances that may affect the appropriateness of a service or recommendation. You should not stop, reduce or alter prescribed medication without first discussing this with the prescribing health professional.
3. COLON HYDROTHERAPY’
Colon hydrotherapy, also known as colonic lavage or colonic irrigation, involves the controlled introduction of water into the colon through a rectal tube. Colon hydrotherapy is provided as a complementary health and wellbeing service. As with any procedure, colon hydrotherapy may involve considerations and risks. Before treatment, clients may be required to complete health screening and consent documentation and will have the opportunity to ask questions about the procedure. We do not make any guarantee about a particular outcome from colon hydrotherapy. We maintain appropriate hygiene, cleaning, disinfection and infection-control procedures in accordance with applicable NSW requirements for the service we provide.
NSW Health currently classifies colonic lavage as a skin penetration procedure under the Public Health Regulation 2022 and requires businesses providing colonic lavage to implement appropriate infection-control practices. (NSW Health)
4. HEALTH SCREENING AND DISCLOSURE
Before receiving certain services, you may be required to complete a health history, screening questionnaire, consultation form and/or consent form. You agree to provide information that is accurate, complete and current to the best of your knowledge. You must tell us about any relevant change in your health before receiving further treatment.
Relevant information may include:
• diagnosed medical conditions;
• current symptoms;
• pregnancy or possible pregnancy;
• recent surgery or medical procedures;
• gastrointestinal or bowel conditions;
• medications;
• supplements;
• allergies or sensitivities;
• recent illness or infection;
• recent hospitalisation; or
• If you’re currently seeking medical or psychiatric support from a doctor
• Any mental health support elsewhere.
• any other circumstance that may be relevant to your suitability for a service.
We rely on the information you provide when determining whether a service is appropriate.Failure to provide relevant information may affect our ability to safely and appropriately provide a service.
5. SUITABILITY FOR SERVICES
Not every service is suitable for every person. We reserve the right to decline, postpone, modify or discontinue a service where we reasonably believe that:
• the service may not be appropriate for you;
• the service may not be appropriate based on information provided;
• additional health information is required;
• you are acutely unwell;
• you are unable to provide informed consent;
• you may require assessment or care from another health professional; or
• continuing the service would not be appropriate in the circumstances.
Where appropriate, we may recommend that you seek medical advice or medical clearance before proceeding. Any decision to decline or discontinue a service is made in the interests of safety and appropriate care.
6. YOUR RIGHT TO STOP A TREATMENT
You may ask us to pause or stop a treatment at any time. You do not need to provide a reason. We may also pause, modify or stop a treatment where we reasonably believe this is necessary or appropriate in the circumstances.
7. INFORMED CONSENT
Before receiving certain services, you may be asked to confirm that you understand the nature of the service and have had the opportunity to ask questions. Where applicable, you may also be asked to acknowledge relevant health screening, contraindications and considerations associated with the service. Consent is voluntary and may be withdrawn at any time. Your consent to a service does not remove or limit any rights you may have under Australian Consumer Law or other applicable legislation.
8. RESULTS AND OUTCOMES
Individual responses to complementary health services vary. We do not guarantee any particular physical, digestive, nutritional, emotional, energetic or wellbeing outcome from our services. Any information about potential benefits or client experiences represents general information or an individual experience and should not be interpreted as a guarantee that you will experience the same outcome.
BOOKINGS, PAYMENTS AND CANCELLATIONS
9. APPOINTMENTS AND BOOKINGS
Appointments may be booked through our online booking system Acuity, by contacting us directly or through another booking method made available by us.
An appointment is confirmed once the booking has been accepted through our booking system or otherwise confirmed by us. When you make a booking, a specific appointment time is reserved for you. You will receive a confirmation email outlining your appointment detail and location.
You are responsible for checking your appointment date, time and location.
10. PAYMENT AT THE TIME OF BOOKING
Payment is taken in full at the time of booking unless otherwise agreed by us in writing. Your payment reserves the appointment time specifically for you. By completing a booking, you agree to the applicable price displayed at the time of booking and authorise payment to be processed.
11. 24-HOUR CANCELLATION AND RESCHEDULING POLICY
We require at least 24 hours’ notice to cancel or reschedule an appointment. The 24-hour period is calculated from the scheduled start time of your appointment. Cancellations or rescheduling with 24 hours or more notice If you provide at least 24 hours’ notice, you may cancel or reschedule your appointment. Where applicable, payment may be transferred to a rescheduled appointment or refunded in accordance with our booking arrangements. Rescheduled appointments remain subject to availability. Cancellations or rescheduling with less than 24 hours’ notice. If you cancel or reschedule your appointment with less than 24 hours’ notice, the appointment time has been reserved for you and we may be unable to offer that time to another client.
Accordingly, the full appointment fee paid at the time of booking will ordinarily be retained as our late cancellation fee.
No-show appointments
If you do not attend your scheduled appointment and have not provided at least 24 hours’ notice, the full appointment fee paid at the time of booking will ordinarily be retained.
Exceptional circumstances. We understand that unexpected circumstances and genuine emergencies can occur.At our discretion, we may choose to waive or reduce the late cancellation/no-show fee in exceptional circumstances.Any decision to waive or reduce the fee is made on a case-by-case basis and does not create an obligation to do so in future circumstances.Nothing in this cancellation policy is intended to exclude, restrict or modify any rights you may have under Australian Consumer Law.
12. LATE ARRIVALS
Please arrive on time for your appointment.
If you arrive late, your appointment may still need to finish at the originally scheduled time so that we can maintain appointments for other clients.
Where possible, we will provide as much of your booked service as the remaining appointment time reasonably allows.
If you arrive sufficiently late that the service cannot reasonably or appropriately be provided, the appointment may need to be cancelled. Where this occurs, the 24-hour cancellation policy may apply.
13. PRICES
Our current prices are displayed on our website, booking system or otherwise communicated to you before booking.
We reserve the right to change our prices from time to time.
Any new pricing will generally apply to future bookings and will not retrospectively change the price of a service already purchased.
14. PACKAGES
Where we offer packages, the price, services included and any applicable expiry period will be communicated at the time of purchase.
Package appointments remain subject to availability and our 24-hour cancellation and rescheduling policy.
Where a package appointment is cancelled with less than 24 hours’ notice or is not attended, we reserve the right to treat that appointment as used and deduct it from the package.
Unless otherwise agreed in writing, packages are for the person who purchased them and are not transferable.
Any package expiry period will be applied subject to applicable law.
15. REFUNDS
Our refund practices are intended to comply with Australian Consumer Law.
Where you cancel an appointment with at least 24 hours’ notice, any applicable refund or transfer of payment will be handled in accordance with our booking arrangements.
Where you cancel with less than 24 hours’ notice or do not attend, the full appointment fee will ordinarily be retained in accordance with our cancellation policy.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee or other right that cannot legally be excluded.
CLIENT RESPONSIBILITIES
16. PROVIDING ACCURATE INFORMATION
You are responsible for providing information that is accurate and complete to the best of your knowledge.
You must notify us if relevant information changes between appointments.
We cannot be responsible for consequences arising from relevant information that has not been disclosed to us.
17. RESPECTFUL CONDUCT
We are committed to providing a safe, respectful and comfortable environment.
Clients are expected to treat practitioners and other clients respectfully.
We do not tolerate:
• threatening behaviour;
• physical aggression;
• harassment;
• discrimination;
• abusive or intimidating behaviour;
• sexual harassment or inappropriate sexual behaviour; or
• deliberate damage to property or equipment.
We may end an appointment where behaviour creates a safety concern.
18. RIGHT TO DECLINE OR END AN APPOINTMENT
We reserve the right to decline or end an appointment where reasonably necessary, including where:
• a service is considered unsuitable;
• relevant health information has not been disclosed;
• a client is unable to provide informed consent;
• a client is abusive, threatening or aggressive;
• a client refuses reasonable safety or hygiene instructions; or
• continuing the appointment would compromise the safety, wellbeing or dignity of the client, practitioner or another person.
Where reasonably possible, we will explain the reason for our decision.
OUR SERVICES
19. NATUROPATHY
Where naturopathy is provided, consultations may include discussion of nutrition, diet, lifestyle, herbal medicine, nutritional supplementation and other naturopathic approaches within the scope of the service provided. Recommendations are based on the information provided and the consultation undertaken. You are responsible for informing us about medications, supplements, allergies, pregnancy, diagnosed conditions and other relevant health circumstances. You should not stop or alter prescribed medication without first discussing this with the prescribing health professional.
20. OVERE ® SPECIALISED KINESIOLOGY AND ENERGETIC PSYCHOLOGY
Where offered, specialised kinesiology and energetic psychology are complementary wellbeing services. These services may involve techniques intended to support relaxation, self-awareness, emotional wellbeing or exploration of physical and energetic experiences. They are not intended to replace appropriate medical or psychological care where such care is required.
21. HYGIENE AND INFECTION CONTROL
We take hygiene and infection control seriously. Our procedures are designed to comply with applicable NSW public health requirements relevant to the services we provide. For colon hydrotherapy and other relevant procedures, we maintain appropriate cleaning, disinfection, single-use and/or sterilisation procedures as applicable. Clients are expected to follow reasonable hygiene and safety instructions provided by us.
NSW Health currently requires colonic lavage businesses to implement infection-control practices and sets requirements relating to equipment, cleaning, practitioner hygiene and the treatment environment. (NSW Health)
22. MEDICAL CARE AND EMERGENCIES
Our services are complementary and are not intended to replace emergency medical care. If we believe that you require medical assessment or urgent medical attention, we may recommend that you seek appropriate medical care. Where we reasonably believe there is an immediate risk to your health or safety, we may contact emergency services or another appropriate person.
PRIVACY AND INFORMATION
23. PRIVACY
We understand that personal and health information is sensitive and we take reasonable steps to protect it.
We may collect personal and health information where reasonably necessary to:
• provide our services;
• assess suitability for treatment;
• conduct consultations;
• manage appointments;
• maintain client records;
• communicate with you;
• process payments;
• improve our services; and
• meet our legal obligations
Our Privacy Policy explains how we collect, use, store and disclose personal and health information and how you can access or correct information we hold about you,
24. CLIENT RECORDS
We may maintain records relating to your appointments, consultations, health information, treatment history, consent and communications with us through Acuity. We will retain and manage records in accordance with applicable legal requirements and our privacy obligations. You may request access to personal information we hold about you, subject to applicable legal exceptions.
WEBSITE TERMS
25. WEBSITE INFORMATION
We make reasonable efforts to ensure that information published on our website is accurate and current. However, information may change and we do not guarantee that all website content will always be complete, current or free from error. Website information is provided for general educational and informational purposes and should not be relied upon as individual medical advice.
26. TESTIMONIALS AND CLIENT EXPERIENCES
We may publish testimonials, reviews or descriptions of individual client experiences. These represent the experiences of those individuals and are not a guarantee that another person will experience the same outcome. We will not intentionally present testimonials in a misleading or deceptive manner.
27. INTELLECTUAL PROPERTY
Unless otherwise stated, all content on our website, including text, photographs, graphics, logos, branding, videos and educational materials, is owned by or licensed to Flow Therapy Byron Pty Ltd. You may use our website for personal, non-commercial purposes. You must not reproduce, copy, modify, distribute, publish, sell or commercially exploit our content without our prior written permission, except where permitted by law.
28. THIRD-PARTY WEBSITES AND SERVICES
Our website may contain links to third-party websites, booking systems, payment providers or other services.
We do not control those third-party services and are not responsible for their content, availability, privacy practices or terms. Your use of third-party services may be subject to the third party’s own terms and conditions and privacy policy
LIABILITY AND LEGAL TERMS
29. LIMITATION OF LIABILITY
Nothing in these Terms excludes, restricts or modifies any liability, right or remedy that cannot legally be excluded, restricted or modified. To the extent permitted by law, we are not responsible for loss or damage arising from circumstances outside our reasonable control or from relevant information that you have failed to disclose to us. Where the law permits a limitation of liability, any limitation will apply only to the extent permitted by law. Nothing in these Terms is intended to prevent you from exercising any rights available to you under the Australian Consumer Law.
30. EVENTS OUTSIDE OUR CONTROL
We are not responsible for delays, cancellations or inability to provide a service caused by circumstances reasonably beyond our control, including natural disasters, serious illness, emergencies, infrastructure failures, power or water outages, government restrictions or other unforeseen circumstances. Where possible, we will contact affected clients and make reasonable efforts to arrange an alternative appointment.
31. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any rights, remedies, guarantees or protections you have under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or any other applicable law where those rights cannot legally be excluded.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you are entitled:
• to cancel your service contract with us; and
• to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If the failure does not amount to a major failure, you are entitled to have problems with the service rectified within a reasonable time and, if this is not done, to cancel your service contract and obtain a refund for the unused portion.

We will endeavour to acknowledge and respond to complaints within a reasonable timeframe. Privacy complaints should be made in accordance with the process outlined in our Privacy Policy.
33. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our services, business practices or legal requirements. The current version will be published on our website together with the date it was last updated. Changes will not retrospectively remove rights or obligations that have already arisen.
34. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising in connection with these Terms or our services will be subject to the applicable laws and courts of New South Wales, subject to any rights you may have under Australian law.
35. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the extent necessary. The remaining provisions will continue to operate.
36. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, applicable consent forms, health screening forms, booking terms and any other documents expressly incorporated into these Terms, form the basis of the agreement between you and Flow Therapy Byron in relation to our services.
Where there is an inconsistency between these Terms and a mandatory requirement of applicable law, the applicable law will prevail.
